We are committed to protecting your privacy and have created this policy (the “Privacy Policy”) in order to demonstrate our commitment to that privacy. This Privacy Policy describes how we collect, use, and share information on the Site, including but not limited to personal information (“Personal Information”) that can be used to identify you or contact you, such as your name, postal address, email address or telephone number that we obtain from and about visitors to the Site. Personal Information includes any non-personally identifiable information (e.g., birthday, age, gender, etc.) that is tied to your Personal Information. By visiting the Site, you consent to our collection, use, and disclosure of your information as described below.

What Types of Information Do We Collect?
To browse the Site, you do not need to provide us with any information. However, we collect Personal Information from you when you voluntarily provide it to us in order to participate in the features or services of the Site, including but not limited to:
- Registration of a user name on the Site;
- Registration for newsletters, marketing, and/or other promotional communications;
- Entering sweepstakes, contests or other promotions;
- Taking surveys or polls;
- Sending e-cards, playing games, and/or using other one-time use features of the Site;
- Providing us with feedback, questions, or comments;
- Any other request that requires the submission of personal information.
In order to participate in some of the above listed features or services, you may be asked to register and use a Site username and password and provide us with Personal Information. During registration, you may also be asked to provide additional non-personally identifiable information such as your age, your date of birth, your gender, your hobbies, and/or other information that is relevant to BYB Brands or the Site. In some instances, we may link or combine non-personally identifiable information with your Personal Information in order to better customize the communications we may send to you or to improve your experience using the Site. If any non-personally identifiable information is linked or combined with your Personal Information, then we will treat the non-personally identifiable information the same as Personal Information.
If you choose not to voluntarily provide us with Personal Information, you may not be able to participate in all of the features or services of the Site and you may limit the services and/or offers that we can provide to you.
How Do We Collect Information From You?
We only collect Personal Information when you voluntarily provide it to us. However, we may use other passive means to collect information about your use of the Site. Below, we describe some of the other ways in which we may collect information about your use of the Site.
Cookies
We use “cookies” (small pieces of information placed on your computer hard drive that may take the form of html files, Flash files or other technology) on certain parts of our Site to allow us to remember user activity and visits to the Site. For instance, cookies may be used to remember portions of the Site that you previously viewed or they may store a username and/or password that you provided when you registered on the Site. We do not use cookies to collect Personal Information, but we may link information contained in a cookie to your Personal Information. We may use 3rd party advertising companies to deliver ads or conduct email campaigns on our behalf. These companies may employ cookies and action tags (also known as single pixel gifs or web beacons) to measure advertising effectiveness.
Log Files and IP Addresses
We may collect (or we may have a third party collect on our behalf) information that is not Personal Information, such as anonymous website traffic data, which may include IP addresses, aggregate user data, Site usage information, and browser type to help diagnose problems with our server, manage and improve the Site, track usage, and for security and monitoring purposes. This information may be stored in the form of log files and aids us in improving the design and layout of the Site.
Additionally, we may monitor the IP addresses of computers that access the Site in order to (i) perform troubleshooting and technical support functions; (ii) maintain Site safety and security; (iii) restrict access to the Site; and (iv) evaluate how that Site is used. Our collection of IP addresses does not provide us with any Personal Information about a visitor to the Site.
Web Beacons
We may also use web beacons on the Site or in email communications we send to you. A web beacon comprises a small string of computer code that allows us to monitor information about your use of the Site or an email that we send to you. We use web beacons to measure advertising effectiveness.
How Do We Use of the Information We Collect?
All information that we collect is used for the purpose for which it was collected or as otherwise described in this Privacy Policy. For instance, when you register for the Site, the information that you provide is used to allow you to access certain features and services on the Site, such as online games. Alternatively, if you sign up for a newsletter, the information that you provide is used to provide you with that newsletter. If your Personal Information is being actively collected by a company other than BYB Brands as part of a promotion, we will let you know at the time when your Personal Information is being collected.
Whenever you provide information to us through the Site, you may also have the option to have your information used for other purposes. For example, when you register for the site, you may be given the opportunity to sign up for newsletters or other promotional communications.
Subject to the terms of this Privacy Policy, we retain your information as long as necessary to provide you with the services for which you initially provided the information. However, at any time, you may contact us and request that we stop using any information that you previously provided to us. However, your information may be retained for a reasonable and necessary time to allow us to comply with various laws and/or other regulations concerning our storage of you information.
If we are using information provided by children under the age of 13, we will first obtain parental consent, if required, pursuant to our Children’s Privacy Policy.
Do We Share the Information We Collect?
Except as disclosed in this Privacy Policy, we do not share or sell your information.
We may share your information with companies that are affiliated with us and with other companies to perform services, including without limitation, facilitating some aspects of our Site, sending e-mail, delivering marketing materials, and organizing sweepstakes, contests or other promotions. These companies may be supplied with or have access to your Personal Information solely for the purpose of providing these services to us or on our behalf. We have agreements with these companies that prevent them from using your Personal Information for any purpose other than what we require them to do with it. If your Personal Information is being shared with another company, we will let you know at the time when your Personal Information is being collected.
Additionally, there may be instances when we may disclose Personal Information without prior notice or consent in order to (1) protect the legal rights of BYB Brands, its employees, agents and contractors; (2) to protect the safety and security of visitors to our site; (3) to protect against fraud or for risk management purposes; or (4) to comply with the laws or legal processes of the United States or other countries.

Notice about Collection and Use of Information
We may work with other companies to provide certain promotions, sweepstakes, contests and/or other functionality of the Site. Although we will indicate whether your information is being collected by or shared with a company other than BYB Brands, we may also provide you with a link to that company’s privacy policy. You should review any third party privacy policies and terms of use before providing any information that may be collected by or shared with a company other than BYB Brands.
How Can You Control the Way in which We Use Your Information?
You have several options to control the ways we use your information:
- You always have to option to not provide us with your Personal Information. Please note, however, that if you do not provide us with your Personal Information, you may have limited access to the services and features of the Site.
- You will have the option to opt out of newsletters, announcements, other communications and/or services from BYB Brands when you provide Personal Information to BYB Brands.
- You may unsubscribe from various promotional or marketing communications by following the unsubscribe instructions provided in each communication.

How Do We Protect Your Information?
We use commercially reasonable administrative, technical, personnel, and physical measures to safeguard Personal Information in our possession against loss, theft and unauthorized use, disclosure or modification. However, no data transmission over the Internet can be guaranteed to be 100% secure. We do not make any warranties about the security of the information that you send to us over the Internet.
Your California Privacy Rights
Beginning on January 1, 2005, California Civil Code Section 1798.83 permits visitors of the Site who are California residents to request certain information regarding its disclosure of personal information to third parties for their direct marketing purposes. Children’s Privacy Policy
Effective as of September 12, 2011
www.tumeyummies.com (the “Site”) is operated by BYB Brands, Inc., which is a United States corporation. BYB Brands is fully committed to complying fully with the Children’s Online Privacy Protection Act of 1998 and has developed this privacy policy to help protect the privacy of children on the Internet and to describe our procedures for collection, using, and disclosing information provided by children under the age of 13. As used herein, the terms “children” or “child” refer to children under the age of 13. We recommend that parents review this information and remind their children to check with a parent or guardian (collectively, “Parent”) before submitting any information over the Internet.
This Children’s Privacy Policy supplements our general Privacy Policy, which is located at www.tumeyummies.com/privacy and is incorporated herein. However, in the event of any disagreement between the Privacy Policy and the Children’s Privacy Policy, this Children’s Privacy Policy shall control. Unless otherwise noted, capitalized terms shall have the same meaning as in the Privacy Policy.
Any changes to this Children’s Privacy Policy will be posted here and any material changes will apply prospectively.
Non-Personally Identifiable Information
Children can utilize most of the functionality and services of the Site without providing any information to BYB Brands. In some instances, children may be required to provide anonymous or non-personally identifiable information (e.g., unique username/password, initials, etc.) in order to access certain functionality of the Site, such as playing games or saving high-scores in games.
Personal Information
If there is functionality or services available through the Site that require children to provide Personal Information, we may collect only the Personal Information that is reasonably necessary to perform that functionality or service. The Personal Information that we may collect includes but is not limited to, the child’s name, the child’s postal address, the child’s email address, the Parent’s name, the Parent’s postal address, the Parent’s email address, and/or the Parent’s telephone number. Functionality or services on the Site that may require a child to provide Personal Information includes but is not limited to, entering contests, sweepstakes or other promotional initiatives, sending e-cards, sending messages to BYB Brands for technical support, sending messages to BYB Brands through the “Contact Us” section of the Site, subscribing to newsletters and/or other promotional communications.
Except for a few limited circumstances, we will only collect, store, and use a child’s Personal Information (including an email address) if we have first received verifiable consent from the child’s Parent. We obtain verifiable parental consent in a variety of ways, including but not limited to, sending an email to the child’s Parent that indicates how the Parent can either approve the collection of the child’s Personal Information or opt their child out from the service or functionality. In some instances, including the disclosure to third parties, we may use other means to obtain consent from the Parent, including getting a signed form from the Parent or taking a phone call from the parent through a toll-free telephone number. If we receive verifiable consent from a Parent, then we may send a follow-up confirmation email or take other steps before storing and continually using the Personal Information. At any time, if a Parent opts their child out of a service or functionality of the Site, then we will delete any Personal Information that we collected from the child.
As described above, in a few limited circumstances, we may not first obtain a Parent’s verifiable consent before collecting a child’s online contact information in conjunction with a service or functionality of the Site. Generally, we do not obtain a Parent’s verifiable consent when only an email address is collected to initiate a one-time service or functionality (e.g., responding to a support request, responding to a message submitted through the “Contact Us” section of the Site, managing a sweepstakes that requires a one-time contact with the child), after which we delete the child’s email address. In other circumstances, we may notify a Parent after we have collected a child’s email address and responded to the child’s request to receive periodic communications (e.g., newsletters, site updates, etc.). We will notify the Parent via email that child has signed up for the periodic communications and provide the Parent with a means to opt the child out of future communications.
BYB Brands will only collect Personal Information directly from children and it does not use any passive means (i.e., cookies) to collect Personal Information from children. However, non-personally identifiable information collected through passive means may be tied to Personal Information.
Third Parties
Sometimes, we may work with a third party that collects Personal Information from children, such as when we use a third party to operate or conduct various sweepstakes, contests, and/or promotions. In such instances, when we need to obtain your verifiable consent, we will provide you with notice of the third party that is collecting the Personal Information. The contact information for all third parties that collect Personal Information on the Site will also be posted to this Children’s Privacy Policy.
We may seek your consent to share a child’s Personal Information with companies that are affiliated with us and with other companies to perform services, including without limitation, sending e-mail, delivering marketing materials, and organizing sweepstakes, contests or other promotions. Before we obtain a Parent’s consent to share a child’s Personal Information with these third parties, we will disclose the business in which the third party is engaged and the general purpose for which the third party will use the information. We will only work with third parties that agree to take commercially reasonably steps to maintain the confidentiality and security of children’s Personal Information and abide by our Children’s Privacy Policy. Additionally, where applicable, we will allow a Parent to consent to BYB Brand’s use of a child’s Personal Information without also providing consent to share that child’s Personal Information with third parties.
When a Parent provides consent to BYB Brands’ collection and use of a child’s Personal Information, BYB Brands may disclose that child’s Personal Information to third parties that are solely providing internal support for a service or functionality of the Site, such as technical support or customer service.
Use of Children’s Information
Once we collect a child’s Personal Information and receive a Parent’s consent (where necessary), the information will only be used for the service and/or functionality for which it was collected and for which the Parent provided consent. For instance, if a child signs up for a newsletter and the Parent consents to this service, then we will only use the child’s personal information to send the newsletter to the child. Similarly, if we collect Personal Information from a child who has entered a sweepstakes and the Parent consents to this service, then we will only use the Personal Information to conduct the sweepstakes.
If we materially change the procedures for the collection, storage, and use of a child’s Personal Information, we will request a new consent from the Parent.
How Can You Control the Way in Which We Use a Child’s Personal Information?
As a Parent that has provided consent to allow us to use your child’s Personal Information, you have the right to request the following:
- Review the Personal Information that we have collected for your child;
- Request that we discontinue using or collecting your child’s Personal Information;
- Request that we delete your child’s Personal Information.
When we request a Parent’s verifiable consent, we provide instructions for how a Parent may perform any of the three tasks mentioned above. Additionally, you may contact us using the information provided below if you have any questions about our use of your child’s Personal Information of if you would like to perform any of the three tasks mentioned above. For verification purposes, please be sure to provide us with your name and email address and your child’s name and email address.
